These Terms of Service ("Terms") govern your access to and use of Brackets and Brews Trivia (the "Service"), operated by Bruce Myers ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
You must be of legal age in your jurisdiction to use the Service. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You agree to provide accurate information and keep it up to date.
You agree not to misuse the Service. Specifically, you must not:
The Service, including its software, design, branding, trivia content (other than user-submitted content), and documentation, is owned by Bruce Myers and is protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial entertainment within the limits of your selected plan. You may not reverse engineer, resell, redistribute, or circumvent any technical limitations of the Service. Brackets and Brews is an unofficial fan trivia platform; all referenced third-party titles, characters, and trademarks belong to their respective owners and are used for identification only.
The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or that any defects will be corrected. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics for paid plans are governed by Paddle's Buyer Terms. Paid subscriptions renew automatically at the interval shown at checkout (e.g. monthly) until cancelled. You can cancel at any time from your billing page or via paddle.net; cancellation takes effect at the end of the current paid period unless otherwise stated.
You retain ownership of any content you submit to the Service (for example, custom trivia questions or chat messages). You grant us a limited, worldwide, royalty-free license to host, store, reproduce, and display such content solely to operate and improve the Service. You are responsible for ensuring you have the rights to any content you submit.
We may suspend or terminate your access to the Service, with or without notice, for material breach of these Terms, non-payment, security or fraud risk, violations of our Community Guidelines, or where required by law. You may terminate your account at any time by emailing hello@bracketandbrew.app. Sections relating to intellectual property, disclaimers, and limitation of liability survive termination.
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid to us (via Paddle) in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be excluded under applicable law.
We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
